Professional Responsibility & Ethics

The MPRE, trust accounts, and the most common causes of attorney disbarment.

Professional responsibility is governed by state-specific adoptions of the ABA Model Rules. The single most common cause of attorney discipline and disbarment is the commingling of client funds.

The IOLTA Account

Interest on Lawyers' Trust Accounts (IOLTA) must be strictly separated from operating funds. If an attorney transfers unearned retainer fees into their operating account to cover rent, they commit an ethics violation, regardless of intent to repay.
